Welcome to Blitz Board Stats, an online platform that provides tools for youth and amateur sports organizations to manage teams, track game statistics, schedule events, communicate with participants, and share athletic performance information. These Terms of Service govern access to and use of the Blitz Board Stats website, applications, and related services (collectively,the "Services”).
By accessing or using the Services, creating an account, registering a team or organization, submitting player information, purchasing a subscription, or otherwise interacting with the Services,you agree to be bound by these Terms of Service and all policies referenced herein. If you do not agree to these Terms of Service, you must not access or use the Services.
Blitz Board Stats LLC, a California limited liability company (“Blitz Board Stats,”“we,”“us,”or “our”), operates a digital platform designed to support sports teams, leagues, and athletic organizations by providing tools for roster management, statistical tracking, scheduling, communication, and related functions.
The Services are intended to be used primarily by adult users such as organization administrators, coaches, team staff, and parents or legal guardians who manage teams and player profiles. The platform may also include information relating to youth athletes, including children under the age of thirteen and teen users between the ages of thirteen and seventeen, which may be submitted and managed by authorized adults.
Because the Services may involve the collection and management of information relating to minors, Blitz Board Stats has implemented policies intended to comply with applicable youth privacy laws, including the Children's Online Privacy Protection Act. Parents and legal guardians play an important role in supervising the use of the Services and managing player profiles associated with their children.
These Terms of Service establish the legally binding agreement between Blitz Board Stats and each user of the Services and govern the rights, responsibilities, and permitted uses of the platform.
Please review these Terms of Service carefully before using the Services.
1. Acceptance of Terms and Agreement to be Bound
a. Binding Agreement. These Terms of Service constitute a legally binding agreement between you and Blitz Board Stats LLC, a California limited liability company governing your access to and use of the Services. By accessing or using the Services, creating an account, registering a team or organization, submitting player information, purchasing a subscription, or otherwise interacting with the Services,you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and any policies referenced herein, including the Blitz Board Stats Privacy Policy. If you do not agree to these Terms of Service, you must not access or use the Services.
b. Authority to Enter Agreement. If you access or use the Services on behalf of a sports organization, team, league, school, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms of Service. In such cases, the terms "you” and "your” refer to both you and the entity you represent.
c. Updates to the Terms. Blitz Board Stats may modify or update these Terms of Service from time to time to reflect changes to the Services, applicable law, or business practices. When changes are made, Blitz Board Stats will update the effective date of the Terms of Service and may provide notice through the Services or by other reasonable means. Your continued use of the Services after updated Terms of Service become effective constitutes your acceptance of the revised Terms of Service.
2. Eligibility and Age Requirements
a. Adult Users. The Services are intended primarily for use by adults who act as organization administrators, coaches, team staff, parents, or legal guardians responsible for managing teams and player information. By creating an account or using the Services, you represent and warrant that you are at least eighteen years of age and have the legal capacity to enter into this agreement. Adult users are responsible for the creation and management of teams, player profiles, communications, and other activities conducted through their accounts.
b. Teen Users Ages 13 Through 17. Individuals between the ages of thirteen and seventeen may access or use certain features of the Services only with the knowledge, supervision, and verifiable consent of a parent or legal guardian. A parent or legal guardian must authorize the creation of any account used by a teen user and remains responsible for supervising the teen's use of the Services, monitoring communications, and ensuring compliance with these Terms of Service. Blitz Board Stats reserves the right to require confirmation of parental or guardian consent for any teen user account.
c. Children Under 13. The Services are not intended for independent use by children under the age of 13. Player profiles for children under the age of 13 may only be created and activated with the consent of a parent or legal guardian. Prior to obtaining verifiable parental consent, the Services may permit the limited entry of a child's name solely for the purpose of initiating the parental consent process. No additional personal information relating to a child under the age of 13 may be entered, displayed, or made active within the Services until verifiable parental consent has been obtained. If verifiable parental consent is not obtained within a reasonable period of time,the Company may delete any pending child profile and associated information. Blitz Board Stats may obtain parental consent through an online consent process in which a parent or legal guardian reviews a consent notice and affirmatively confirms consent through a submission action on the website.
d. Parental and Guardian Consent and Responsibility. Parents and legal guardians who submit information relating to a minor, authorize a minor's participation, or permit a minor to use the Services represent and warrant that they have the legal authority to provide consent for the collection, use, and disclosure of the minor's information in connection with the Services. Parents and legal guardians are responsible for supervising a minor's use of the Services, including any communications, media uploads, player information, or other content associated with the minor's participation on the platform. Blitz Board Stats may implement reasonable measures to verify parental or guardian consent for the collection or processing of information relating to minors in accordance with applicable law.
3. User Accounts and Registration
a. Account Creation. Access to certain features of the Services requires the creation of a user account. Users may be required to register an account in order to create or manage teams, enter player information, access statistics, communicate with other users, or use other platform features. When creating an account, you agree to provide accurate, current, and complete information and to maintain and promptly update such information as necessary to keep it accurate and complete. Blitz Board Stats reserves the right to refuse registration, suspend accounts, or remove user access if provided information is inaccurate, misleading, or violates these Terms of Service.
b. Account Security. You are responsible for maintaining the confidentiality of your account credentials, including your username and password, and for restricting access to your account. You agree to notify Blitz Board Stats promptly if you become aware of any unauthorized access to or use of your account or any other breach of security. Blitz Board Stats is not responsible for any loss or damage resulting from your failure to maintain the security of your account credentials.
c. Accuracy of Account Information. You represent and warrant that all information you provide in connection with your account, including contact information, organizational affiliation, and any information relating to player profiles, is accurate and provided with appropriate authority. If you provide information on behalf of a team, organization, player, or minor, you represent and warrant that you have the legal authority and necessary permissions to submit such information through the Services.
d. Responsibility for Account Activity. You are responsible for all activities that occur under your account, including the creation of teams, submission of player information, entry of statistics, communications sent through the platform, and the uploading of media or other content. If you authorize other individuals to access or use your account or grant administrative access to team staff or other users, you remain responsible for activities conducted through those accounts and for ensuring compliance with these Terms of Service.
e. Authority to Create Player Profiles. If you create or manage team rosters, player profiles, or similar records through the Services, you represent and warrant that you have the legal authority to provide the information submitted about each player. If the player is under the age of 18, you further represent and warrant that the player's parent or legal guardian has authorized the creation of the player profile and the submission of the player's information to the Services. You are responsible for ensuring that all information submitted for player profiles is accurate and provided with appropriate authorization. The Company reserves the right to remove, suspend, or disable any player profile if it reasonably believes that the information was submitted without appropriate authorization.
f. Child Player Profiles and Parental Consent. Player profiles for children under the age of 13 may only be activated after verifiable parental consent has been obtained. Prior to obtaining verifiable parental consent, the Services may permit the limited entry of a child's name and a parent or guardian's email address solely for the purpose of initiating the parental consent process. No additional personal information relating to a child under the age of 13 may be entered, displayed, or made active within the Services until verifiable parental consent has been obtained. If verifiable parental consent is not obtained within a reasonable period of time, the Company may delete any pending child profile and associated information.
4. Roles Within the Platform
a. Organization Administrators. Organization administrators are users who create or manage accounts oon behalf of a team, league, school, or other athletic organization. Organization administrators may have authority to create teams, invite coaches and staff, manage subscriptions, configure organization settings, and oversee player information associated with the organization. Organization administrators are responsible for ensuring that individuals granted access to the Services within their organization comply with these Terms of Service and applicable laws.
b. Coaches and Team Staff. Coaches and authorized team staff may use the Services to manage team rosters, record game statistics, schedule events, communicate with participants, and perform other team management functions available through the platform. Coaches and team staff may be granted administrative privileges by an organization administrator or other authorized account holder. Coaches and team staff are responsible for ensuring that player information and statistics entered into the Services are submitted with appropriate authorization and in compliance with these Terms of Service.
c. Parents and Guardians. Parents and legal guardians may use the Services to manage player profiles, review team information, receive communications, and interact with team-related features made available through the platform. Parents and legal guardians are responsible for ensuring that information submitted about their child is accurate and that any participation by the child in connection with the Services occurs under appropriate supervision and with proper authorization.
d. Player Profiles. Player profiles may be created within the Services to identify individual athletes participating on a team. Player profiles may include information such as player name,jersey number, team affiliation, game statistics, and other athletic performance data.Player profiles relating to minors must be created and managed by an authorized adult, such as a parent, legal guardian, coach, or organization administrator acting with appropriate permission. Blitz Board Stats does not permit children under the age of thirteen to independently create accounts or directly manage player profiles.
5. Player Profiles and Youth Athlete Information
a. Creation of Player Profiles. The Services allow authorized users to create player profiles for athletes participating on a team. Player profiles may include information such as player name, jersey number, team affiliation, position, game statistics, and other athletic performance information entered through the platform. Player profiles must be created only by authorized adults, including organization administrators, coaches, team staff, parents, or legal guardians who have the authority to submit such information on behalf of the player. If a player profile relates to a child under the age of thirteen, the profile will remain in a pending status and will not be activated until a parent or legal guardian has provided verifiable parental consent in accordance with the Blitz Board Stats Parental Notice and Consent for Collection and Use of Children's Information.
b. Parental Control of Player Information. Parents and legal guardians retain primary authority over information relating to their minor children. A parent or legal guardian may request modification or removal of a player profile associated with their child by contacting the organization administrator, coach, or Blitz Board Stats through the contact information provided in these Terms of Service. Blitz Board Stats may require reasonable verification of parental or guardian identity before modifying or removing information associated with a minor.
c. Visibility of Player Statistics and Profiles. Player profiles and associated statistics are intended to be visible only to authorized users within the relevant team environment. Player profile information, statistics, and related content are not publicly searchable or publicly visible on the internet through the Services. Access to player profiles, statistics, and team information is limited to users associated with the applicable team or organization, such as coaches, team administrators, and authorized guardians.
d. Removal or Modification of Player Information. Authorized users may update or modify player profile information through the administrative tools available within the Services. Blitz Board Stats reserves the right to remove, restrict access to, or modify player profile information if the information violates these Terms of Service, infringes the rights of another person, or presents safety or privacy concerns involving a minor.
6. Platform Services and Functionality
a. Team and Organization Management Tools. The Services provide tools that allow users to create and manage teams, organizations, and related participant information. Authorized users may organize team rosters, assign players, manage staff access, and configure team or organizational settings within the platform. Users are responsible for ensuring that any information submitted in connection with team or organizational management is accurate and submitted with appropriate authority.
b. Game Statistics Tracking. The Services allow authorized users to record and track game statistics and athletic performance information during practices, scrimmages, and competitive events. Statistics entered into the platform may include individual player performance data, team statistics, scoring information, and other gameplay metrics. Users who enter statistical information are responsible for the accuracy and completeness of the information they submit.
c. Scheduling and Team Management Features. The Services may provide scheduling tools that allow users to create and manage team events, including practices,games, scrimmages, meetings, and other activities. Authorized users may distribute event information and updates to other users associated with the team or organization. Blitz Board Stats is not responsible for errors, scheduling conflicts, or changes to events entered by users.
d. Communication Features. The Services may include communication tools that allow authorized users to send messages, notifications, or other communications to coaches, team staff,parents, guardians, and other authorized participants. Users are responsible for all communications sent through the platform and must ensure that such communications comply with these Terms of Service and applicable laws.
e. Data Analytics and Leaderboards. The Services may generate summaries, analytics, rankings, or leaderboards based on statistical data entered into the platform. These features are intended for informational and recreational purposes and rely on information submitted by users. Blitz Board Stats does not guarantee the accuracy, completeness, or reliability of statistical data, rankings, or other analytics generated through the Services.
7. SMS Messaging and Electronic Communications
a. Consent to Receive Communications. By creating an account, providing contact information, or using the Services, you consent to receive communications from Blitz Board Stats through electronic means, including email, in-platform notifications, and text messages where applicable. These communications may include service-related notices, administrative messages, account notifications, scheduling updates, team communications, and other information relating to the Services. Consent to receive SMS messages is not a condition of purchasing any goods or services.
b. SMS Messaging Services. The Services may include features that allow users to send or receive text messages or other mobile communications related to team activities, event notifications, or platform updates. If you provide a mobile phone number in connection with your account or a team profile, you represent and warrant that the number is accurate and that you are authorized to receive text messages at that number.
c. Opt-In Requirements. Users may receive SMS messages only after providing prior express consent or opting in to receive such messages through the Services or another authorized consent mechanism. If you provide a mobile phone number on behalf of another person, including a parent, guardian, coach, or other participant, you represent and warrant that you have the authority and consent necessary to provide that number for messaging purposes.
d. Opt-Out Instructions. Users may opt out of receiving SMS messages at any time by following the opt-out instructions provided in the message, which may include replying with a designated keyword such as STOP. After a user sends a valid opt-out request, Blitz Board Stats will process the request and discontinue sending SMS messages to that mobile number except as required to confirm the opt-out request. After opting out, users may continue to receive non-SMS communications such as email notifications or in-platform messages unless those communications are separately disabled.
e. Message and Data Rates. Message and data rates may apply to SMS messages sent or received through the Services according to the terms of the user's mobile service provider. Blitz Board Stats is not responsible for any messaging charges incurred by users.
f. Responsibility for Mobile Numbers. Users are responsible for ensuring that any mobile phone numbers provided through the Services are accurate and belong to individuals who have consented to receive communications. Users must promptly update or remove mobile numbers that are no longer valid or authorized for messaging.
g. Messaging Disclosures. Message frequency may vary depending on team activity, event schedules,and platform notifications. Users may reply STOP to any SMS message to opt out of receiving further text messages or reply HELP for assistance. Message and data rates may apply depending on the user's mobile carrier and service plan. Mobile carriers are not liable for delayed or undelivered messages.
8. Subscriptions, Billing, and Payment
a. Subscription Plans. Certain features of the Services may require the purchase of a subscription. Blitz Board Stats may offer subscription plans for teams, organizations, or other users that provide access to specific platform features or functionality. Subscription plans, pricing, and included features may be described on the Blitz Board Stats website or within the Services and may be modified from time to time.
b. Plan Activation. A subscription may become active when a user selects a subscription plan, schedules an event requiring an active plan, or otherwise completes the subscription activation process within the Services. By activating a subscription,you agree to pay the applicable fees associated with the selected plan.
c. Billing Cycles. Subscriptions may be offered on a monthly, annual, or other recurring billing cycle as specified at the time of purchase. Unless otherwise stated, subscription fees will be billed in advance for each billing period. Subscriptions may automatically renew at the end of each billing cycle unless canceled in accordance with these Terms of Service.
d. Payment Authorization. By purchasing a subscription, you authorize Blitz Board Stats and its payment processing providers to charge the payment method you provide for all applicable subscription fees, taxes, and other charges associated with your use of the Services. You agree to maintain valid and current payment information and authorize Blitz Board Stats to charge your payment method for any renewal or recurring subscription fees.
e. Cancellations. Users may cancel a subscription at any time through the account management tools within the Services or by contacting Blitz Board Stats. Unless otherwise specified, cancellation will take effect at the end of the current billing period, and the subscription will remain active until that billing period expires.
f. Refund Policy. Except where required by law or expressly stated otherwise, subscription fees are non-refundable once a billing period has begun. Blitz Board Stats may, in its sole discretion, issue refunds, credits, or adjustments in specific circumstances.
g. Payment Failures, Taxes, and Plan Changes. If Blitz Board Stats is unable to successfully charge your designated payment method for any subscription fee, Blitz Board Stats may suspend or restrict access to subscription features until payment is successfully processed. You agree to promptly update your payment information if your payment method becomes invalid or expired. Subscription fees do not include any applicable taxes unless otherwise stated. You are responsible for any applicable sales, use, value-added, or similar taxes associated with your purchase of a subscription. Blitz Board Stats reserves the right to modify subscription pricing, plan features, or billing structures from time to time. If Blitz Board Stats changes the pricing of an existing subscription plan, the updated pricing will apply beginning with the next billing cycle following notice of the change.
9. User CContent and Media Uploads
a. User Generated Content. The Services may allow users to submit, upload,transmit,or otherwise provide content through the platform, including player information, statistics, photographs, videos, messages, comments, team information, and other materials (collectively,"User Content”). You are solely responsible for any User Content that you submit through the Services and for ensuring that such User Content complies with these Terms of Service and applicable law. Blitz Board Stats does not monitor all User Content and does not guarantee the accuracy, integrity,or legality of content submitted by users.
b. Player Profile Images. The Services may allow authorized users to upload a profile photograph associated with a player profile. Media uploads are limited to player profile images and may be visible only to authorized users within the relevant team environment. Users uploading a player profile image that depicts a minor represent and warrant that they have obtained any necessary parental or guardian consent required to upload and display the image through the Services. The Services do not currently permit the uploading of game footage, practice recordings, or other video media.
c. Player Statistics and Game Data. Statistical information entered into the Services, including player performance data, scores, rankings, and other game statistics, constitutes User Content submitted by users of the platform. Users who enter or modify statistical data are responsible for the accuracy of that information and represent that they have the authority to submit such data in connection with the relevant team,event, or organization.
d. License Granted to Blitz Board Stats. By submitting User Content through the Services, you grant Blitz Board Stats a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, process, adapt, format, display, distribute, and otherwise use the User Content for the purpose of operating, maintaining, securing, and improving the Services. This license includes the right to display User Content within the platform in connection with team pages, game summaries, statistical reports, analytics, rankings, leaderboards, and other features of the Services. The license also permits Blitz Board Stats to create backup copies, perform technical formatting, conduct analytics related to platform functionality, and otherwise process User Content as necessary to provide the Services. Blitz Board Stats does not claim ownership of User Content submitted by users. Blitz Board Stats may also generate, use, and retain aggregated or deidentified statistical data derived from User Content and platform activity for lawful business purposes including analytics, platform improvement, and development of new services.
e. Rights and Permissions for User Content. You represent and warrant that you own or have all necessary rights, licenses, permissions, and consents required to submit User Content through the Services and to grant the license described in these Terms of Service. Without limiting the foregoing, you represent and warrant that:
i.the User Content does not infringe the copyright, trademark, trade secret, or other intellectual property rights of any person or entity;
ii.the User Content does not violate any privacy rights, publicity rights,or other personal rights of any individual;
iii. you have obtained all necessary permissions from parents or legal guardians before submitting User Content that includes or relates to a minor;and
iv. you have the legal authority to provide any personal information,images,or media submitted through the Services.
f. Content Review and Removal. Blitz Board Stats reserves the right, but not the obligation, to review, remove, restrict access to, or modify any User Content that violates these Terms of Service, infringes the rights of another person, presents safety or privacy concerns involving a minor, or otherwise creates legal or operational risk for the Services. Blitz Board Stats may also remove or restrict User Content in response to claims of copyright infringement or other intellectual property violations.
g. Safety and Protection of Youth Participants. Because the Services may involve youth athletes and information relating to minors, Blitz Board Stats is committed to maintaining a safe environment for participants. Blitz Board Stats reserves the right to monitor platform activity, review reported content, and remove or restrict access to any User Content, communications, media, or player information that may endanger the safety, privacy, or well-being of a minor.
Users are encouraged to report any content or conduct that may involve harassment, exploitation, unauthorized sharing of images, unsafe imagery, misuse of player information, or other harmful activity involving minors. Reports may be submitted by contacting Blitz Board Stats using the contact information provided in these Terms of Service or through any reporting tools that may be made available within the Services.
Blitz Board Stats may investigate reported activity and may remove content, suspend accounts, restrict access to features, or take other enforcement actions as appropriate. Blitz Board Stats may also cooperate with law enforcement authorities or appropriate regulatory agencies in connection with investigations involving the safety of minors or unlawful content.
10. Acceptable UJse and Platform Conduct
a. Compliance with Law. You agree to use the Services only for lawful purposes and in compliance with these Terms of Service and all applicable laws and regulations. You must not use the Services in any manner that violates the rights of any person, including intellectual property rights, privacy rights, or the rights of minors.
b. Prohibited Activities. Users must not use the Services to engage in any activity that interferes with the operation, security, or integrity of the platform. Without limitation, users must not:
i. access or attempt to access accounts, data, or systems without authorization;
ii. interfere with or disrupt the Services or servers connected to the Services;
iii. introduce viruses, malware, or other harmful code into the Services;
iv. attempt to scrape, copy, harvest, or extract data from the Services through automated means without authorization;or
v. use the Services in any manner intended to damage, disable, or impair the functionality of the platform.
c. Protection of Minors. Because the Services may involve youth athletes and player profiles relating to minors, users must exercise appropriate care when submitting content or communicating through the platform. Users must not upload,share,or distribute content involving minors that is unlawful, abusive, exploitative, threatening, or otherwise inappropriate.
d. Harassment and Abuse. Users must not use the Services to harass, threaten, intimidate, or abuse any other person. Communications sent through the Services must not include hate speech, bullying, discrimination, or other abusive conduct.
e. Misuse of Communication Features. Users must not use messaging, notification, or communication features of the Services to send spam, unsolicited promotional messages, or misleading communications. Users must also not impersonate another person or falsely represent their affiliation with a team, organization, or individual.
f. Enforcement. Blitz Board Stats reserves the right, in its sole discretion, to investigate suspected violations of these Terms of Service and to take any action it deems appropriate to protect the Services, its users, or third parties. Without limitation, Blitz Board Stats may remove content, restrict access to certain features, suspend user accounts, or terminate access to the Services at any time, with or without notice,and for any reason or no reason.
11. Intellectual Property Rights
a. Ownership of the Services. The Services, including all software, technology,databases, designs,graphics, interfaces, text, functionality, and other materials provided by Blitz Board Stats, are owned by or licensed to Blitz Board Stats and are protected by applicable intellectual property laws. Except for the limited rights expressly granted in these Terms of Service, no rights, title, or interest in or to the Services or any intellectual property associated with the Services are transferred to you.
b. Trademarks and Branding. The name Blitz Board Stats, the Blitz Board Stats logo,and all related names, logos, product names, service names, designs, and slogans are trademarks or service marks of Blitz Board Stats or its licensors. You may not use any trademarks, logos, or branding of Blitz Board Stats without the prior written permission of Blitz Board Stats.
c. Limited License to Use the Services. Subject to your compliance with these Terms of Service, Blitz Board Stats grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for their intended purposes. This license does not permit you to reproduce, distribute, publicly display, modify,create derivative works from, sell, license, or otherwise exploit any portion of the Services except as expressly authorized by Blitz Board Stats.
d. Restrictions on Platform Content. You must not copy, reproduce, republish, distribute, transmit,display, perform, create derivative works from, or otherwise exploit any content,software, or materials available through the Services without the prior written consent of Blitz Board Stats, except as necessary to use the Services for their intended purposes. You must not reverse engineer, decompile, disassemble, or attempt to derive the source code of any software used to provide the Services except where such activity is expressly permitted by applicable law.
12. Copyright Infringement and DMCA Policy
a. Reporting Copyright Infringement. Blitz Board Stats respects the intellectualI property rights of others and expects users of the Services to do the same. If you believe that material available through the Services infringes your copyright, you may submit a notification of claimed infringement in accordance with the Digital Millennium Copyright Act.
b. DMCA Notice Requirements. To be effective under the Digital Millennium Copyright Act, a notification of claimed copyright infringement must include substantially the following information:
i. identification of the copyrighted work claimed to have been infringed;
ii. identification of the material that is claimed to be infringing and information reasonably sufficient to permit Blitz Board Stats to locate the material;
iii. the name, address, telephone number, and email address of the complaining party;
iv. a statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent,or the law;
v. a statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of the copyright that is allegedly infringed; and
vi. a physical or electronic signature of the person authorized to act on behalf of the copyright owner.
c. Counter Notification. If you believe that material you submitted to the Services was removed or disabled as a result of mistake or misidentification, you may submit a counter notification to Blitz Board Stats. To be effective under the Digital Millennium Copyright Act, the counter notification must include substantially the following information:
i. identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled;
ii. the name, address, telephone number, and email address of the person submitting the counter notification;
iii. a statement under penalty of perjury that the person submitting the counter notification has a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
iv. a statement that the person submitting the counter notification consents to the jurisdiction of the federal district court for the judicial district in which the person's address is located, or if the address is outside the United States,for any judicial district in which Blitz Board Stats may be found, and that the person will accept service of process from the person who submitted the original infringement notification or an agent of that person; and
v. a physical or electronic signature of the person submitting the counter notification.
Blitz Board Stats may restore the removed material in accordance with applicable law following receipt oof a valid counter notification.
d. Repeat Infringer Policy. Blitz Board Stats maintains a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers of copyright or other intellectual property rights.

a. Third Party Services. The Services may allow users to connect with, export data to,or otherwise interact with third party platforms, services, or tools. These third-party services are operated independently from Blitz Board Stats and are not under the control of Blitz Board Stats. Blitz Board Stats is not responsible for the availability, accuracy, policies, or practices of any third-party services accessed through or in connection with the Services.
b. Data Exports and Integrations. The Services may permit users to export statistical data, game information, or other content to external sports platforms or services. Users are solely responsible for ensuring that exported data is accurate and submitted in accordance with the requirements of the receiving platform. Blitz Board Stats does not guarantee compatibility with any third-party platform and is not responsible for errors, delays, or failures associated with data exports or integrations.
c. No Affiliation with Third Party Platforms. Reference to any third-party platform, service, or organization within the Services does not constitute sponsorship, endorsement, or affiliation unless expressly stated. Blitz Board Stats is not affiliated with or endorsed by any third-party sports platform, league, or organization unless such relationship is explicitly identified.
d. Third Party Terms and Policies. If you access or use a third-party service in connection with the Services, your use of that service may be subject to additional terms, conditions, and privacy policies imposed by the third-party provider. Blitz Board Stats is not responsible for the terms, policies, or practices of any third-party services.
14. Privacy and Data Protection
a. Privacy Policy. The collection, use, storage, and disclosure of personal information through the Services are governed by the Blitz Board Stats Privacy Policy and, where applicable, the Parental Notice and Consent for Collection and Use of Children's Information. These documents are incorporated into these Terms of Service by reference and form part of this agreement. By accessing or using the Services,you acknowledge that you have reviewed the Privacy Policy and agree to the collection, use,and disclosure of information as described in the Privacy Policy.
b. Children's Privacy and Parental Consent. Because the Services may involve information relating to youth athletes, Blitz Board Stats implements procedures designed to obtain verifiable parental consent in accordance with the Children's Online Privacy Protection Act before activating player profiles for children under the age of thirteen. When a coach, team administrator, or other authorized adult creates a player profile for an individual under thirteen, the profile will remain in a pending status until a parent or legal guardian provides consent. A notification is sent to the parent or guardian requesting approval of the player profile and explaining the information that may be collected and displayed through the Services. The player profile and related statistics are not activated or visible within the Services until the parent or legal guardian confirms consent. Blitz Board Stats maintains a record of parental consent, which may include the parent or guardian's contact information, the date and time consent was provided, and other information reasonably necessary to document consent.
c. Parental Rights Regarding Minor Data. Parents and legal guardians have the right to review, request correction of, oor request deletion of personal information associated with their minor child, subject to applicable law and reasonable verification of parental or guardian identity. Requests relating to the personal information of minors may be submitted to Blitz Board Stats using the contact information provided in these Terms of Service.
d. User Responsibility for Submitted Information. Users who submit personal information relating to players, parents, coaches, or other individuals represent and warrant that they have the legal authority to provide such information through the Services and that such submission complies with applicable privacy laws and organizational policies. Blitz Board Stats implements reasonable safeguards designed to protect personal information submitted through the Services but relies in part on the representations of authorized adult users that they have obtained the permissions and consents required to submit such information, including information relating to minors.
e. Data Retention and Deletion. Blitz Board Stats retains personal information only for as long as reasonably necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce these Terms of Service. Personal information may be deleted, anonymized, or retained in backup or archival systems in accordance with the Blitz Board Stats Privacy Policy and applicable law.
15. Service Availability and Modifications
a. Service Availability. Blitz Board Stats strives to maintain the availability and reliability of the Services but does not guarantee that the Services will be uninterrupted, error-free,or available at all times. Blitz Board Stats may modify, update, or improve the features, functionality, or user interface of the Services at any time.
c. Modifications to the Services. Blitz Board Stats reserves the right to modify, suspend, discontinue, or restrict access to any portion of the Services at any time and for any reason, with or without notice. Blitz Board Stats will not be liable for any modification, suspension, or discontinuation of the Services or any feature of the Services.

a. Services Provided As Is and As Available. The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied,or statutory. To the fullest extent permitted by applicable law, Blitz Board Stats disclaims all warranties relating to the Services, including any implied warranties of merchantability,fitness for a particular purpose, title, non-infringement, accuracy, reliability, or availability. Blitz Board Stats does not warrant that the Services will operate without interruption, that defects will be corrected, or that the Services or servers that make the Services available are free of viruses or other harmful components.
b. Accuracy of Statistics and Data. The Services allow users to record, submit, and display statistical information relating to athletic performance, including player statistics,game results, rankings, and other data. All statistical information available through the Services is generated from information submitted by users. Blitz Board Stats does not verify, audit, or guarantee the accuracy, completeness, or reliability of any statistics, rankings, analytics, or other data displayed through the Services. Users acknowledge that statistical information displayed through the Services is provided for informational and recreational purposes only and should not be relied upon as an official record of athletic performance.
c. User Generated Content. Blitz Board Stats does not control and is not responsible for User Content submitted by users, including player information, statistics, photographs, videos, communications, or other materials. Blitz Board Stats does not endorse, verify, or guarantee the accuracy,legality, or appropriateness of User Content submitted through the Services. Any reliance on User Content is at the user's own risk.
d. Third Party Services and Content. The Services may include links to third party platforms, integrations, or external services. Blitz Board Stats does not control and is not responsible for the content, policies, practices, or availability of any third-party services. Any interaction with third party services is conducted at the user's own risk and may be subject to the terms and policies of the applicable third-party provider.
e. No Athletic, Recruiting, or Professional Guarantees. The Services may provide analytics, rankings, leaderboards, or other information relating to athletic performance. Such information is generated based on user-submitted data and is intended solely for informational purposes. Blitz Board Stats does not guarantee athletic outcomes, recruiting opportunities, player rankings, or any athletic advancement based on the use of the Services. Users acknowledge that statistical rankings, leaderboards, and performance analytics displayed through the Services may influence perceptions of athletic performance. Blitz Board Stats shall not be responsible for any reputational impact, evaluation, or interpretation of player performance resulting from statistics, rankings, or other data displayed through the Services.
f. Use Involving Minors. The Services may include information relating to minors that is submitted by authorized users such as parents, legal guardians, coaches, or organization administrators. Blitz Board Stats implements measures intended to promote the responsible submission of information relating to minors, including policies requiring that users obtain appropriate parental or guardian consent before submitting such information.However, Blitz Board Stats cannot independently verify parental consent for every item of information or media submitted to the Services and relies in part on the representations of authorized users that they have obtained all necessary permissions and consents required to submit such information. Blitz Board Stats reserves the right to remove or restrict access to information involving minors if it reasonably believes the information was submitted without appropriate authorization or presents safety or privacy concerns.
17.Limitation of Liability
a. Limitation of Liability. To the fullest extent permitted by applicable law, Blitz Board Stats and its members, managers, officers, employees, contractors, agents,licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out oof or relating to the use of or inability to use the Services. Without limitation, Blitz Board Stats shall not be liable for damages relating to loss of profits, loss of revenue, loss of data, loss of business opportunities, loss of goodwill, interruption of service, security incidents, unauthorized access to accounts or data, data breaches, or other intangible losses arising out of or relating to the Services.
b. User Content and Third-Party Conduct. Blitz Board Stats shall not be liable for any damages arising out of or relating to User Content submitted by users, including player information, statistics, photographs, videos, communications, or other materials submitted through the Services. Blitz Board Stats shall also not be liable for the conduct of any user, coach, parent, guardian, organization administrator, team staff member, or other individual who accesses or uses the Services.
c. Statistical Information and Platform Data. Blitz Board Stats shall not be liable for any damages arising out of or relating to the accuracy, completeness, or reliability of player statistics, rankings, analytics, or other data displayed through the Services. Users acknowledge that statistical information is generated based on data submitted by users and is provided for informational purposes only.
d. Third-Party Services. Blitz Board Stats shall not be liable for any damages arising out of or relating to third party platforms, integrations, services, or external websites accessed through or in connection with the Services.
e. Data Security and Unauthorized Access. Blitz Board Stats implements reasonable administrative, technical, and organizational safeguards designed to protect information maintained through the Services. However, no method of transmission over the internet or method of electronic storage can be guaranteed to be completely secure. To the fullest extent permitted by applicable law, Blitz Board Stats shall I not be liable for any unauthorized access to, alteration of, disclosure of, or loss of data resulting from circumstances beyond its reasonable control, including but not limited to cyber attacks, hacking attempts, malware, security breaches affecting third-party service providers, telecommunications failures, or unauthorized access resulting from compromised user credentials.
f. Information Submitted by Users. The Services rely on users such as parents, legal guardians,coaches, and organization administrators to submit information relating to players and other individuals. Blitz Board Stats shall not be liable for any damages arising out of or relating to personal information, media, or other data submitted to the Services by users without proper authorization, including information relating to minors. Blitz Board Stats relies on the representations of users that they have obtained all necessary permissions and consents required to submit such information.
g. Aggregate Liability Cap. To the fullest extent permitted by applicable law, the total cumulative liability of Blitz Board Stats for any claims arising out of or relating to the Services or these Terms of Service shall not exceed the greater of:
i. the total amount paid by the user to Blitz Board Stats for the Services during the twelve-month period preceding the event giving rise to the claim; or
ii. one hundred dollars.
h. Basis of the Bargain. Users acknowledge that the limitations of liability set forth in these Terms of Service are a fundamental element of the agreement between the parties and that Blitz Board Stats would not provide the Services without such limitations.
18. Indemnification
a. User Indemnification. You agree to defend, indemnify, and hold harmless Blitz Board Stats and its members, managers, officers, employees, contractors, agents, licensors, and service providers (collectively, "Representatives") from and against any and all claims, demands, actions, proceedings, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees and legal costs (collectively,“Claims”),arising out of or relating to your use of the Services.
b. User Content and Submitted Information. You agree to defend, indemnify, and hold harmless Blitz Board Stats and its Representatives from any Claims arising out of or relating to User Content submitted through the Services, including player information, statistics,photographs, videos, communications, or other materials submitted by you or through your account.
c. Information Relating to Minors. You agree to defend, indemnify, and hold harmless Blitz Board Stats and its Representatives from any Claims arising out of or relating to the submission, publication, or display of information or media relating to a minor where such information was submitted without appropriate parental or guardian consent or other required authorization.
d. Intellectual Property Claims. You agree to defend, indemnify, and hold harmless Blitz Board Stats and its Representatives from any Claims alleging that User Content submitted through the Services infringes or violates the copyright, trademark, privacy rights, publicity rights, or other legal rights of any person or entity.
e. Violations of Law or These Terms. You agree to defend, indemnify, and hold harmless Blitz Board Stats and its Representatives from any Claims arising out of or relating to your violation of these Terms of Service or your violation of any applicable law or regulation in connection with your use of the Services.
f. Cooperation in Defense. Blitz Board Stats reserves the right to assume the exclusive defense and control of any matter subject to indemnification under this section. You agree to cooperate fully with Blitz Board Stats in the defense of any such Claim and may not settle any Claim without the prior written consent of Blitz Board Stats if the settlement would impose any obligation or liability on Blitz Board Stats or its Representatives.
19. Termination and Account Suspension
a. Termination by Users. Users may stop using the Services at any time. Users may also request termination of their account by using the account management tools available within the Services or by contacting Blitz Board Stats. Termination of an account does not relieve the user of any obligations incurred prior to the effective date of termination, including payment obligations associated with an active subscription.
b. Suspension or Termination by Blitz Board Stats. Blitz Board Stats reserves the right, in its sole discretion, to suspend, restrict, or terminate a user's access to the Services at any time, with or without notice, and for any reason or no reason. Without limitation, Blitz Board Stats may suspend or terminate accounts that violate these Terms of Service, present safety concerns involving minors, create legal risk for the Services, interfere with the operation of the platform, or otherwise pose a risk to Blitz Board Stats or its users.
c. Effect of Termination. Upon termination or suspension of an account, a user's right to access or use the Services will immediately cease. Blitz Board Stats may retain or delete account information, User Content, and related data in accordance with its internal policies and applicable law.
d. Survival. Any provisions of these Terms of Service that by their nature should survive termination will remain in effect following termination, including but not limited to provisions relating to intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and any accrued payment obligations.
20.Governing Law.
These Terms of Service and any dispute, claim, or controversy arising out of or relating to the Services or these Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.
21. Dispute Resolution and Arbitration
a. Agreement to Arbitrate. Except as otherwise provided in these Terms of Service,you and Blitz Board Stats agree that any dispute, claim, or controversy arising out of or relating to the Services or these Terms of Service, including the formation, interpretation,breach, termination, enforcement, or validity thereof, shall be resolved exclusively through final and binding arbitration. By agreeing to these Terms of Service, you and Blitz Board Stats knowingly and voluntarily waive the right to bring claims in court or to have disputes resolved by a judge or jury, except as expressly provided in these Terms of Service. If you are a parent or legal guardian accepting these Terms of Service on behalf of a minor, you agree to these Terms both individually and on behalf of the minor. You further agree that any dispute relating to the minor's use of the Services, the submission of information relating to the minor, or the minor's participation in activities associated with the Services will be resolved in accordance with this arbitration provision.
b. Class Action Waiver. To the fullest extent permitted by applicable law, you and Blitz Board Stats agree that any arbitration or other dispute resolution proceeding shall be conducted solely on an individual basis and not as part of any class, collective, consolidated, or representative action. You agree that you may bring claims only on your own behalf and not on behalf of any other person or group. The arbitrator shall have no authority to consolidate claims or to conduct any form of class or representative proceeding.
c. Arbitration Administration and Rules. Arbitration shall be administered by the American Arbitration Association ("AAA”) in accordance with its applicable rules in effect at the time the claim is filed, including the AAA Consumer Arbitration Rules where applicable. The arbitration shall be conducted by a single neutral arbitrator. Unless otherwise required by applicable law, the arbitration shall take place in the State of California. The arbitration may be conducted remotely through video conference, telephone, or written submissions as permitted by the applicable AAA rules and as determined by the arbitrator.
d. Authority of the Arbitrator. The arbitrator shall have the authority to determine the scope, enforceability, and applicability of this arbitration provision and to grant any remedy or relief that would otherwise be available in a court of competent jurisdiction, subject to the limitations set forth in these Terms of Service. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
e. Exceptions to Arbitration. Notwithstanding the foregoing, Blitz Board Stats may seek injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property rights, confidential information, or other proprietary interests. Either party may also bring an individual claim in a small claims court if the claim qualifies under the applicable jurisdictional rules of that court. For any dispute that is permitted to proceed in court under this subsection, the parties agree that such dispute shall be brought exclusively in the state or federal courts located in the State of California, and the parties consent to the personal jurisdiction of those courts.
f. Severability of Arbitration Provision. If any portion of this arbitration provision is found to be unenforceable, the remaining portions shall remain in full force and effect, except that if the class action waiver in subsection (b) is found to be unenforceable, the arbitration requirement shall be deemed void with respect to that claim.
22. Changes to These Terms.
Blitz Board Stats reserves the right to modify or update these Terms of Service at any time to reflect changes to the Services, applicable law, or business practices. If Blitz Board Stats makes material changes to these Terms of Service, Blitz Board Stats may provide notice through the Services, by email, or by other reasonable means. The updated Terms of Service will become effective on the date indicated by the updated effective date. Your continued use of the Services after the effective date of the revised Terms of Service constitutes your acceptance of the updated Terms of Service. 24.Miscellaneous
a. Waiver. The failure of Blitz Board Stats to enforce any provision of these Terms of Service shall not be deemed a waiver of that provision or of the right to enforce that provision at a later time. Any waiver of a provision of these Terms of Service must be in writing and signed by an authorized representative of Blitz Board Stats.
b. Force Majeure. Blitz Board Stats shall not be liable for any delay or failure to perform its obligations under these Terms of Service if such delay or failure results from events or circumstances beyond its reasonable control. Such events may include, without limitation, acts of God, natural disasters, fire, flood, earthquake, war, terrorism,civil unrest, labor disputes, government actions, interruptions or failures of internet or telecommunications infrastructure, cyber attacks, distributed denial-of-service attacks, failures of third-party hosting or service providers, or widespread power outages. During the period of such events, Blitz Board Stats' obligations under these Terms of Service will be suspended to the extent reasonably necessary to address the event.
c. Severability. If any provision of these Terms of Service is determined by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable,the remaining provisions shall remain in full force and effect to the maximum extent permitted by applicable law.
d. Entire Agreement. These Terms of Service, together with the Privacy Policy and any policies or terms expressly incorporated by reference, constitute the entire agreement between you and Blitz Board Stats regarding the Services and supersede all prior or contemporaneous agreements, communications, and understandings relating to the Services.
e. Assignment. You may not assign or transfer these Terms of Service or any rights or obligations under these Terms of Service without the prior written consent of Blitz Board Stats. Blitz Board Stats may assign or transfer these Terms of Service without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of assets.
f. Notices. Blitz Board Stats may provide notices to users through the Services, by email, by text message where applicable, or by other reasonable electronic means. You agree that such electronic communications satisfy any legal requirement that notices be provided in writing.
g. Limitation on Time to Bring Claims. To the fullest extent permitted by applicable law, any claim or cause of action arising out of or relating to the Services or these Terms of Service must be filed within one year after the claim arises, or such claim or cause of action will be permanently barred.
